As it is known, in paragraph (b) of the second paragraph of Article 80 of Law no. 5510, it is envisaged that employers cannot be less than 30 times of the maximum daily earnings of the prime earnings of employees. If it is determined to be low, the prime earnings of the employer must be increased to the earning limit of the highest wage earner.
With the amendment made in Article 98 of the Regulation, it is stated that the aforementioned law provisions shall not apply to the partners of the legal entities. In this case, the actual amount of earnings per share declared by the real person or ordinary company partners to SGK will not be less than 30 times the highest of the prime earnings of the insured employees.
On the other hand, this amendment will be effective from 1/10/2008.
